These Terms & Conditions (“Terms”) apply to your use of sikkimsupreme.co.in (the “Site”) and to every order placed through it. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are

The Site is operated by the Government Fruit Preservation Factory (“GFPF”, “we”, “us”, “our”), a Public Sector Undertaking of the Government of Sikkim under the Department of Commerce & Industries. Sikkim Supreme is GFPF’s consumer brand. We have been preserving Sikkim’s harvest since 1956.

2. Eligibility

To create an account or place an order, you must be at least 18 years old and legally able to enter into a contract under Indian law. If you are under 18, you may use the Site only under the supervision of a parent or legal guardian, who will be responsible for any order placed. By using the Site, you confirm that the information you give us is true, accurate and complete.

3. Your Account

  • You are responsible for keeping your login details confidential and for all activity under your account.
  • Please keep your account information accurate and up to date, including business details if you hold a business account (see Section 8).
  • If you suspect anyone has used your account without permission, tell us immediately at [email protected].
  • We may suspend or close any account that is used fraudulently or in breach of these Terms.

4. Our Products

  • Natural variation. Our products are made from Himalayan produce grown in Sikkim. Colour, texture, flavour and heat may vary slightly from batch to batch. This is natural and is not a defect.
  • Labels come first. Before use, please read the product label for ingredients, allergen information, storage instructions and best-before date. If the label and the Site differ, the label on the product you receive applies.
  • Heat warning. Dalle Khursani is one of the hottest chillies in the world. Products made with it should be used in small amounts at first and kept out of the reach of children.
  • Images. Product photographs are for illustration. Packaging may differ slightly from what is shown.
  • Availability. All products are subject to availability. We may change or discontinue any product without notice.

5. Prices & Bulk Pricing

  • All prices are in Indian Rupees (₹). Applicable taxes and any delivery charges are shown at checkout before you pay.
  • Each product has two published prices: a retail price, and a bulk price that applies automatically once your order quantity reaches the threshold shown on that product’s page.
  • The Site shows no other discount tiers. For rates below the published bulk price, such as very large or recurring volumes, contact us through the business enquiry form on our Business page or at [email protected]. Negotiated prices are agreed directly and confirmed in writing. They are not available through the Site’s checkout.
  • We may change prices at any time. The price that applies to your order is the one shown when you placed it.
  • If a product is listed at an obviously incorrect price, we will contact you before processing the order. You may then either continue at the correct price or cancel for a full refund.

6. Orders

  • Placing an order is an offer to buy. Our order confirmation (by email or SMS) only confirms that we have received your order. A contract is formed when we dispatch your order.
  • We may decline or cancel an order, including after payment, if a product is unavailable, a pricing or listing error has occurred, we suspect fraud, or the delivery address is outside our service area. If this happens after you have paid, you will receive a full refund to your original payment method, as set out in our Cancellation & Refund Policy.
  • We may limit the quantity of any product per order or per customer, including on bulk orders.

7. Payment

  • Payments are processed securely by our payment gateway partner, Razorpay. You can pay by credit or debit card, UPI, net banking and selected wallets.
  • We do not see or store your full card details. Our Privacy Policy explains how payment information is handled.
  • If money is deducted from your account but your order is not confirmed, the amount is normally reversed automatically by your bank or the payment gateway. If it has not been reversed, write to us at [email protected] with your transaction details.

8. Business Accounts & GST Invoices

  • Any buyer can open a business account. It gives access to GST invoicing, order history and repeat or standing orders. Business accounts use the same login as consumer accounts and are covered by these Terms.
  • You are responsible for the accuracy of the GSTIN and business details you provide. We cannot be responsible for any loss of input tax credit caused by incorrect or outdated details.
  • Repeat and standing orders are subject to stock availability and to the prices in effect when each order is placed.
  • Any separate terms agreed in writing for custom or large-volume arrangements apply alongside these Terms. Where the two conflict, the written agreement applies.

9. Shipping, Cancellations & Refunds

Delivery timelines, cancellation windows and refund eligibility are set out in our Shipping Policy and our Cancellation & Refund Policy. Both form part of these Terms.

10. Intellectual Property

  • All content on the Site belongs to GFPF, the Government of Sikkim or its licensors, and is protected by Indian intellectual property law. This includes the Sikkim Supreme name and logo, product names, photographs, designs and written content.
  • “Dalle Khursani” is a Geographical Indication (GI) registered for its region of origin. We use the name on the Site under that registration. We do not claim it as a trademark exclusive to Sikkim Supreme.
  • You may not copy, reproduce, distribute or use any Site content for commercial purposes without our written permission.

11. Reviews & Your Content

By posting a review, comment or other content on the Site, you confirm that:

  • it reflects your own genuine experience of the product;
  • you have not been paid or rewarded to write it unless you say so clearly; and
  • it does not infringe anyone else’s rights.

You give us a non-exclusive, royalty-free right to display and use that content on the Site and in our marketing. We may remove any content that is false, misleading, abusive or in breach of these Terms.

12. Prohibited Use

You must not use the Site to:

  • break any applicable law or regulation;
  • attempt to gain unauthorised access to our systems or to other users’ accounts;
  • upload malicious code or interfere with the Site’s operation;
  • misrepresent your identity or business affiliation; or
  • access the Site with bots, scrapers or other automated tools without our written permission.

13. Limitation of Liability

To the extent permitted by law, we are not liable for any indirect, incidental or consequential loss arising from your use of the Site. Our total liability for any order will not exceed the amount you paid for that order. Nothing in these Terms limits or excludes any right you have, or any liability we owe, under the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, the Food Safety and Standards Act, 2006, or any other law that cannot be excluded by contract.

14. Indemnity

You agree to compensate GFPF for any claim, loss or damage caused by your breach of these Terms or your misuse of the Site.

15. Events Beyond Our Control

We are not responsible for delays or failures caused by events outside our reasonable control. These include natural disasters, landslides, road closures, severe weather, strikes, pandemics and government action. Sikkim’s mountain roads can close at short notice, especially during the monsoon, so we will keep you informed of any delay that affects your order.

16. Grievance Redressal

As required by the Consumer Protection (E-Commerce) Rules, 2020, we have appointed a Grievance Officer to handle consumer and order complaints.

We will acknowledge your complaint within 48 hours and aim to resolve it within one month of receiving it. You may also contact the National Consumer Helpline on 1915.

17. Changes to These Terms

We may update these Terms from time to time. Any change is effective from the date shown as “Last updated” above. It will not affect orders already placed. By continuing to use the Site after a change, you accept the revised Terms.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute arising from them or from your use of the Site is subject to the exclusive jurisdiction of the courts of Sikkim. This does not affect your right to approach a consumer commission under the Consumer Protection Act, 2019.

19. General

If any part of these Terms is found invalid or unenforceable, the rest remains in effect. If we do not enforce a right under these Terms, we have not waived it. These Terms, together with our Privacy Policy, Shipping Policy and Cancellation & Refund Policy, are the entire agreement between you and us for your use of the Site.
