These Terms & Conditions (“Terms”) govern your use of sikkimsupreme.co.in (the “Site”) and any purchase made through it. By accessing the Site or placing an order, you agree to these Terms. If you don’t agree, please don’t use the Site.

1. About Us

Sikkim Supreme is the flagship consumer brand of the Government Fruit Preservation Factory (GFPF), a Public Sector Undertaking of the Government of Sikkim, operating under the state’s Department of Commerce & Industries.

2. Eligibility

You must be at least 18 years old, or using the Site under the supervision of a parent/legal guardian, to create an account or place an order. By using the Site, you confirm that the information you provide is accurate and that you have the legal capacity to enter into a purchase agreement.

3. Account Registration

• You’re responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• Provide accurate, current information when registering, including for business accounts (see Section 8).
• Notify us immediately if you suspect unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.

4. Products & Pricing

• We make every effort to display product information, images, and prices accurately, but errors can occur. If we discover a pricing or listing error after you’ve placed an order, we’ll contact you before processing the order, and you may cancel if you don’t wish to proceed at the corrected price.
• Prices are listed in Indian Rupees (₹) and are subject to change without notice, though changes won’t affect orders already confirmed.
• Product availability is not guaranteed and may change without notice.

5. Pricing Model — Retail & Bulk

Every product on the Site displays two prices: a standard retail price, and a bulk price that applies automatically once your order quantity crosses the threshold shown on the product page. No further discount tiers are published on the Site; buyers seeking rates below the published bulk price should contact our Business Sales team, where any further pricing is negotiated and confirmed directly, off-platform.

6. Orders & Acceptance

• Placing an order constitutes an offer to purchase, which we may accept or decline (e.g. in cases of suspected fraud, stock unavailability, or pricing errors).
• Order confirmation (email/SMS) confirms we’ve received your order — it does not guarantee acceptance until the order is dispatched.
• We reserve the right to limit order quantities per customer or per order, at our discretion, including on bulk purchases.

7. Payment

• Payments are processed via our checkout platform (FluentCart) and third-party payment gateway partners, supporting cards, UPI, net banking, and select wallets.
• We do not store your full payment card details — see our [Privacy Policy] for detail on how payment data is handled.
• Business accounts ordering via GST invoicing are subject to applicable tax law; GST details provided must be accurate and current.

8. Business Accounts

Business account registration is optional and available to any buyer wishing to access GST invoicing, order history, and repeat/standing order features. Business accounts sit on the same login system as consumer accounts and are subject to these same Terms, in addition to any terms specifically agreed with our Business Sales team for custom or large-volume arrangements.

9. Shipping, Cancellation & Returns

Shipping timelines, cancellation windows, and return eligibility are governed by our separate [Shipping Policy] and [Cancellation & Return Policy], both incorporated into these Terms by reference.

10. Intellectual Property

• All content on this Site — including but not limited to the Sikkim Supreme name, logo, product names, photography, and written content — is the property of GFPF/Government of Sikkim or its licensors, and is protected under applicable Indian intellectual property law.
• The “Dalle Khursani” Geographical Indication (GI) tag and associated protections belong to the registered GI holder and applicable region, and are referenced on this Site under that protection, not claimed as Sikkim Supreme’s exclusive trademark.
• You may not reproduce, distribute, or use any Site content for commercial purposes without our prior written permission.

11. User-Generated Content

If you submit a product review, comment, or other content to the Site:

• You confirm it’s your own genuine opinion/experience and doesn’t infringe on any third party’s rights.
• You grant us a non-exclusive, royalty-free right to display, reproduce, and use that content in connection with the Site and our marketing.
• We reserve the right to remove any content that violates these Terms, is abusive, false, or otherwise inappropriate, at our discretion.

12. Prohibited Use

You agree not to use the Site to:

• Violate any applicable law or regulation
• Attempt unauthorised access to our systems, other users’ accounts, or Site infrastructure
• Upload malicious code, or interfere with the Site’s normal operation
• Misrepresent your identity or affiliation
• Use automated systems (bots, scrapers) to access the Site without our prior written consent

13. Limitation of Liability

To the maximum extent permitted by applicable law, GFPF/Sikkim Supreme is not liable for indirect, incidental, or consequential damages arising from your use of the Site or its products, beyond the value of the order in question. Nothing in these Terms limits any liability that cannot be excluded under Indian consumer protection law, including the Consumer Protection Act, 2019, and the Consumer Protection (E-Commerce) Rules, 2020.

💡 This clause in particular needs qualified legal review — liability limitation language for a government-owned food business selling consumable products is a genuine area where the wrong wording creates real exposure.

14. Indemnification

You agree to indemnify and hold GFPF/Sikkim Supreme harmless from any claim, loss, or damage arising from your violation of these Terms or misuse of the Site.

15. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020, we’ve designated a Grievance Officer to address consumer complaints. See our [Privacy Policy] for current Grievance Officer contact details, which apply to complaints under these Terms as well.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. We’ll update the “Last Updated” date above whenever changes are made.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of Sikkim.
